These Terms of Use ("Terms") govern your access to and use of the websites, services, and SMS programs operated by Clear Path Demand LLC DBA Solid Air Co. ("Company", "we", "us", or "our"), including www.solidairco.com and the websites and booking pages we operate on behalf of our clients. By accessing or using our websites or services, including SMS communications, you agree to these Terms. If you do not agree, please do not use our websites or services.
1Who We Are and What These Terms Cover
Solid Air Co. is a marketing agency serving heating, ventilation, and air conditioning (HVAC) businesses. These Terms apply in two contexts:
- Our own website, where HVAC business owners learn about and contact us.
- Websites and booking pages we operate for clients, where homeowners and other consumers request service from an HVAC business.
If you are a Solid Air Co. client, the services we provide to you are governed by your signed services agreement with us. If anything in these Terms conflicts with that agreement, the signed agreement controls.
If you request service from an HVAC business through a page we operate, your service relationship is with that business, not with us. These Terms govern your use of the page itself and any SMS program you opt into through it.
2SMS Program Description
Clear Path Demand LLC DBA Solid Air Co. offers SMS messaging programs, on our own behalf and on behalf of the HVAC businesses we serve, that may include:
- Account notifications.
- Customer support communications.
- Appointment reminders.
- Promotional offers and updates (where consent is provided).
3SMS Opt-In and Opt-Out
By opting into an SMS program, you agree to receive text messages as described above.
Opt-Out: Reply STOP at any time to unsubscribe.
Help: Reply HELP to any message, or contact privacy@solidairco.com.
Message Frequency: May vary.
Message and Data Rates: Standard message and data rates may apply depending on your carrier plan.
4Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
5SMS Eligibility
You must be at least 18 years old to participate in our SMS programs.
6Acceptable Use
When using our websites and services, you agree not to:
- Use them for any unlawful purpose or in violation of these Terms.
- Interfere with or disrupt the operation or security of any website or service.
- Use automated means (scrapers, bots, crawlers) to access or collect content or data without our written permission.
- Submit false or misleading information through any form or booking page.
- Attempt to gain unauthorized access to any systems or accounts.
7Intellectual Property
The content on our websites, including text, graphics, logos, page designs, and analyses, is owned by Clear Path Demand LLC or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent, except for your own personal, non-commercial reference.

Our websites may link to third-party websites or rely on third-party services (for example, scheduling or advertising platforms). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their own terms.

Marketing performance data, industry benchmarks, and examples shown on our websites describe past or aggregate results. They are not a promise or assurance of results for any business. Advertising outcomes depend on factors outside our control, including market conditions, competition, and budget.
10Limitation of Liability
To the fullest extent permitted by law, Clear Path Demand LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of our websites or services. To the fullest extent permitted by law, our total liability for any claim arising out of these Terms or your use of our websites will not exceed one hundred dollars ($100) or the amount you paid us for the service giving rise to the claim, whichever is greater. Nothing in these Terms limits liability that cannot be limited under applicable law. Client engagements are subject to the liability terms of the applicable signed services agreement, which control for those engagements.
11Indemnification
You agree to indemnify and hold harmless Clear Path Demand LLC and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of our websites or services.
12Privacy
Your use of our websites and participation in any SMS program are subject to our Privacy Policy, which describes how we collect, use, and protect your information. By opting into an SMS program, you agree to the collection and use of information as described there.
13Modifications
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our websites or services after a change takes effect means you accept the updated Terms.
14Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of our websites or services will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction.
15Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. These Terms, together with our Privacy Policy and, for clients, the applicable signed services agreement, are the entire agreement between you and us regarding use of our websites and services.
